About these terms
These terms govern use of the website operated by DIGITAL SHIFT LLC, based in New Mexico, United States. Please read them before using the site. If you do not agree, do not use the website. Our privacy policy explains how information is handled; these terms do not replace any consent required by privacy law.
Website information and service agreements
Descriptions, articles, examples and project showcases provide general information about our work. They do not promise that every project will achieve the same outcome. A form submission or initial conversation does not create a service contract or reserve delivery capacity.
Paid work requires a separate written agreement setting out scope, deliverables, responsibilities, fees, payment schedule, timelines, acceptance, ownership and any support arrangements. That agreement controls if it conflicts with these terms on the contracted services.
Estimates, prices and offers
The instant estimate uses your description and selected answers to provide an indicative budget. Incomplete or uncertain answers can affect the result. Questions and summaries may be prepared automatically and may contain errors; review them and tell us about anything inaccurate. Our team must confirm the scope, price and schedule before you commit.
Unless expressly stated otherwise, estimates are in US dollars and exclude applicable taxes, ongoing operating costs, paid external services, content creation and future maintenance. A displayed estimate is not a binding quotation, invoice, payment request or guarantee of availability. Discounts and promotional offers require confirmation of eligibility, scope and any stated conditions in the written proposal.
Acceptable use
You may browse the site and use its forms for legitimate enquiries. Do not use it for unlawful, deceptive or harmful purposes; submit malicious files or unsolicited bulk messages; impersonate others; infringe privacy or intellectual property rights; or attempt to access information or accounts without permission.
Do not bypass access controls or request limits, interfere with service operation, or collect site information in a way that disrupts the service or infringes others’ rights. We may restrict access where reasonably necessary to address misuse, protect users or comply with law.
Information and materials you submit
You retain your rights in materials you submit. You give us permission to use them as needed to review your enquiry, prepare an estimate, communicate with you and provide agreed services, subject to our privacy policy and any separate agreement. You must have the rights and permissions needed to share those materials.
Public enquiry forms are not intended for passwords, payment credentials, highly sensitive personal information or confidential documents. Sending an enquiry alone does not create a confidentiality agreement. If your project requires special confidentiality arrangements, agree them with us before sharing restricted material.
Intellectual property
Unless indicated otherwise, the website’s original text, design and other materials belong to DIGITAL SHIFT LLC or its licensors. Third-party names, marks and materials belong to their respective owners; their appearance does not by itself imply an endorsement or partnership.
You may view the site and retain copies for internal evaluation of our services. You may not commercially republish, sell or present our materials as your own without permission or another lawful basis. Ownership of commissioned work is determined by the applicable service agreement.
External websites and services
Links to products, customer websites or other resources are provided for convenience. We do not control their content, availability or practices. Your use of a separate service is subject to its own terms and privacy policy. Contact the relevant operator about issues with that service.
Availability and accuracy
We aim to keep the website useful and accurate, but content can change and errors or interruptions may occur. We may update, suspend or discontinue website features for maintenance, security or business reasons. To the extent permitted by law, the website and its general information are provided as available, without a guarantee of uninterrupted access or fitness for a particular purpose. This does not alter commitments made in a signed service agreement.
Responsibility and legal protections
To the extent permitted by applicable law, we are not responsible for indirect or consequential losses arising from use of, or inability to use, this website, including lost profits or opportunities caused by reliance on general website information. Responsibility for paid services is addressed in the relevant agreement.
Nothing in these terms excludes or limits responsibility that cannot lawfully be excluded or limited, including for fraud or any mandatory consumer rights. Any limitation applies only to the extent allowed in your circumstances.
Questions, disputes and applicable law
Please contact [email protected] with any concern and enough detail for us to investigate. We encourage a good-faith effort to resolve concerns directly, without limiting your right to seek legal remedies or contact a competent authority.
These website terms are governed by the laws of New Mexico, United States, subject to mandatory protections and jurisdiction rules that apply where you live. A separate service agreement may specify the law and dispute process for contracted work. These terms do not require arbitration or waive rights that cannot lawfully be waived.
Changes and interpretation
We may revise these terms as the website or legal requirements change. The date on this page identifies the current version. Changes apply prospectively and do not rewrite existing service agreements. Where notice or agreement is legally required, the change is subject to that requirement.
If a provision cannot be enforced, the remaining provisions continue to apply to the extent permitted by law. A delay in enforcing a right does not waive it. We provide these terms in English, Arabic and Spanish for accessibility; mandatory local-language protections remain unaffected. Contact us if you notice a difference that affects your understanding.
